You must provide accurate information when you create an account and keep it up to date. You are responsible for the activity under your account and for keeping your credentials secure. Notify us promptly if you believe your account has been accessed without authorization.

You must be able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.

You retain all rights to the designs, models, documents, and other content you create or upload (“Your Content”). You grant us a limited license to host, store, process, and display Your Content solely to operate and provide the Service to you.

You are responsible for Your Content and for ensuring you have the rights to use it. Do not upload content that infringes the rights of others or that you are not permitted to share.

You agree not to:

• break the law or infringe the rights of others through the Service;
• interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure;
• reverse engineer, resell, or misuse the Service except as permitted by these Terms or applicable law;
• upload malware, or use the Service to store or transmit harmful or unlawful content.

We are continually developing the Service and may add, change, or remove features. We aim for reliable availability but do not guarantee the Service will be uninterrupted or error-free, and we may suspend it for maintenance or to protect the Service or its users.

The Service, including its software, design, and trademarks, is owned by us or our licensors and is protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or branding.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose. Arkim is engineering software: you are responsible for independently verifying any design, calculation, simulation result, or exported file before relying on it for manufacturing, construction, or any other purpose.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim, or, if you paid nothing, to one hundred U.S. dollars.

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably need to in order to protect the Service or other users. On termination, the provisions of these Terms that by their nature should survive will survive.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
